By purchasing a subscription to the Switzer Report you are agreeing to be bound by the below terms and conditions.
1. Terms of Use
The Switzer Report is owned and published by Switzer Financial Group Pty Ltd (ABN 24 112 294 649). Please review the below Terms & Conditions thoroughly. If you do not agree to these Terms, you should not obtain information, services or products from this site. The Switzer Report reserves the right to review and modify any of the Terms of Use at any time.
2. Subscriber Agreement
Changes: We may change the terms of this Agreement at any time by notifying you of the change electronically (including by email or by posting a notice on the Switzer Report that the terms have been “updated”). The changes also will appear in this document, which is accessible in the “MORE INFORMATION” section of the footer on all pages of this service. You signify that you agree to be bound by such changes by using the Switzer Report after changes are made to this Agreement.
3. Fees and Payments
You agree to pay the subscription fees and any other charges incurred in connection with your username and password for the Switzer Report (including any applicable taxes) at the rates in effect when the charges were incurred. We will bill all charges automatically to your credit card. Subscription fees will be billed at the beginning of your subscription or any renewal. Unless we state in writing otherwise, all fees and charges are non-refundable and subscriptions terms cannot be suspended. We may change the fees and charges then in effect, or add new fees or charges, by giving you notice in advance.
4. Money Back Guarantee
Switzer offers a 30-Day money back guarantee subject to the following conditions:
- You signed up to your subscription on a page which displays the ‘Money Back Guarantee’ badge;
- You purchased an annual subscription and paid with a credit card. Subscribers who pay for their subscription via any means other than credit card are not eligible for a refund;
- You have subscribed to the report for no less than 30 days and at the time of requesting your refund had opened 80% of the delivered newsletters;
- You have requested a refund from Switzer in writing between 30 and 45 days after subscribing;
- You provide Switzer with feedback as to what you were expecting from the report, and how you feel the report didn’t live up to these expectations.
Refunds will be credited into the same account from which the original payment was made. Switzer reserves the right to refuse a refund if they feel that the subscriber does not meet the above conditions. No refunds will be provided after 45 days.
5. RenewalÂ
Unless otherwise stated, credit card subscriptions will renew automatically at the conclusion of your subscription period at the full retail price ($397 for an annual subscription and $35 for a monthly subscription), unless we terminate it or you notify us by telephone, mail, or e-mail (receipt of which must be confirmed by email reply from us) that you do not wish for your subscription to renew automatically. You must cancel your subscription before it renews in order to avoid the billing of a subscription fee.
6. Limitations on Use
a.    Only one individual may access the Switzer Report at the same time using the same username or password, unless we agree otherwise.
b.   All protectable intellectual property available through the Switzer Report are our property or the property of our advertisers and licensors and are protected by copyright and other intellectual property laws. Unless you have our written consent, you may not sell, publish, distribute, retransmit or otherwise provide access to content received through the Switzer Report to anyone, with the following exception:
(i)Â You may download, store and create an archive of articles from the Switzer Report for your personal use, but you may not otherwise provide access to such an archive to more than a few individuals on an occasional basis. The foregoing does not apply to any sharing functionality we provide through the Switzer Super Report that expressly allows you to share articles or links to articles with others.
c.    You agree not to rearrange or modify the Content. You agree not to create abstracts from, scrape or display our content for use on another web site or the Switzer Report (other than headlines from our RSS Feed with active links back to the full article on the Service). You agree not to post any content from the Switzer Report (other than headlines from our RSS Feed with active links back to the full article on the service) to weblogs, newsgroups, mail lists or electronic bulletin boards, without our written consent.
d.    You agree not to use the Switzer Report for any unlawful purpose. We reserve the right to terminate or restrict your access to the Switzer Report if, in our opinion, your use of the service may violate any laws, regulations or rulings, infringe upon another person’s rights or violate the terms of this Agreement. Also, we may refuse to grant you a username that impersonates someone else, is protected by trademark or other proprietary right law, or is vulgar or otherwise offensive.
7. General
If any part of this Agreement is invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms and Conditions are governed by and interpreted in accordance with the laws of the State of New South Wales, Australia.
8. Disclaimer of Warranties and LiabilityÂ
The Switzer Report does not attest to the completeness or accuracy of the content or its usefulness for any particular purpose. The Switzer Report and its employees, contractors, parent, affiliates or agents are not liable for any direct, indirect, incidental or any other type of loss or injury resulting from your use, or downloading of our content.
